IDENTITY AND DOMICILE OF THE RESPONSIBLE
De la Vega y Martinez Rojas, S.C. hereinafter “DLVMR” with domicile at: Carretera Federal Mexico-Toluca 5422 – Piso 4, Colonia el Yaqui Cuajimalpa, Ciudad de Mexico, C.P. 05320, which it appoints as domicile to hear and receive notifications; in line with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the Law), the Regulations of the Federal Law on the Protection of Personal Data Held by Private Parties (the Regulations) and the Guidelines for the Privacy Notice (the Guidelines).
PERSONAL DATA COLLECTED
DLVMR may collect the personal data necessary for the compliance of the purposes established in this notice, which include but are not limited to the following: (i) name, (ii) domicile, (iii) company and position in the same, (iv) fixed telephone number, office telephone number and/or mobile telephone number, (v) e-mail address, (vi) taxpayer registry number (tax ID), and (vii) activity or profession, (viii) basic information required for the existence of a legal relationship, including labor relationships, (ix) information necessary for the compliance of obligations provided in applicable laws.
In addition to the personal data mentioned before, DLVMR may collect sensitive personal data such as that related to the matter entrusted to DLVMR or information that you may provide to better evaluate the case; by signing this Notice, you grant your express consent to collect and process them.
MAIN PURPOSES
The personal data collected by DLVMR, will be managed and processed in accordance with the applicable Law, Regulations and Guidelines and with the purpose of rendering the services provided by DLVMR to its clients; the main targets for their processing are the following: (iii) to process and follow up on the legal services that have been engaged with DLVMR; (vii) updating the legal relationship that may exist between the client and DLVMR; (viii) those derived from the labor relationship that may exist with DLVMR; (ix) invoicing, clarification, as well as monitoring and collection activities.
SECONDARY PURPOSES
In the same way, DLVMR may process your personal data with the following secondary purposes: (i) sending information, newsletters and legal news or issues that DLVMR considers that may be of interest for the client or users, as well as news, communications or publicity of DLVMR; (ii) delivery of invitations to conferences, seminars, pro-bono events, cultural, social or sports events in which DLVMR participates, and/or (iii) delivery of communications and invitations to participate in projects of DLVMR or which DLVMR considers, at is discretion, that may interest you.
In case you are not willing that DLVMR processes your personal data for one or all the purposes mentioned before, you may notify your decision at any time by means sending an e-mail to contacto@DLVMR.com.mx, or through a written communication sent to our domicile located at Carretera Federal Mexico-Toluca 5422, Piso 4, Colonia El Yaqui, Cuajimalpa, Ciudad de Mexico, C.P. 05320.
TRANSFER OF PERSONAL DATA
We inform you that your personal data may be transferred to entities or individuals from outside DLVMR, such as its net of correspondents, with the sole purpose of providing a better service, so by signing this Notice, you expressly grant your consent for such data transfer.
MEANS TO COLLECT YOUR PERSONAL DATA
DLVMR may collect your personal data through the digital environment such as the Web Site or electronic communications held between you and DLVMR, as well as via Courier, presentation cards, employees of the data owner and telephone communications.
We inform you that DLVMR does not collect data automatically from cookies or web beacons, or similar technologies.
Means to exercise your rights of access, correction, amendment, cancellation, opposition and limitation to the processing of your personal data.
You have the right to know what personal data we have collected from you, the use we give them, and the conditions under which we give access to them (Access). Moreover, it is your right to request the correction of your personal data in case it is out-of-date, inaccurate or incomplete (Correction); that we delete it from our registries or data bases when it is considered not being use in line with the principles, duties and obligations provided by the ordinances (Cancellation); as well as to oppose to its use for specific purposes (Opposition). These rights are commonly known as ARCO, for their acronym in Spanish.
For the exercise and proceedings related with the ARCO rights, you may contact the Responsible of Privacy in DLVMR by sending an e-mail to: contacto@DLVMR.com.mx.
In such e-mail, you will have to include:
- Full Name of the data owner.
- In case you act through a legal representative, specify the legal representative’s name and enclose an electronic copy of the proxy letter or the certified power of attorney.
- E-mail where you will receive the answer to your request.
- Specify which ARCO right you want to exercise, if you want to exercise the limitation of use or disclosure or if you want to revoke the consent for the processing of your personal data.
- In case you request the correction, please specify the incorrect datum and the change you want to make, enclosing any document to accredit that the new datum provided is correct.
- In case you are willing to limit the use or disclosure, specify which secondary purpose you want to limit.
Also, as provided by the Law for the Protection of Personal Data Held by Private Parties you will have to include any document that accredits you identity, which may be:
- Personal ID.
- Passport.
- Military Service Card.
- Professional License.
- Migration document certifying the legal stance of the non-Mexican national in our country.
In case that the information provided in the request Form is incorrect or not enough, or the accreditation documents are not enclosed, the Responsible of Privacy in DLVMR, within five (5) days following the reception of the request, may ask you to provide the necessary documents or elements to start processing it. You will have ten (10) business days to fulfill the requirement, which will start running on the day following the date on which you received it. If you do not fulfill the requirement within such term, your request will be deemed as not filed.
The Responsible of Privacy in DLVMR will inform you the decision made within twenty (20) business days starting from the date on which your request was received, with the purpose that you, if admissible, make it effective within fifteen (15) business days following the notification of the response. The response will be delivered via e-mail to the address specified in the e-mail’s contents.
If the limitation of use or disclosure of your data has been requested and if admissible, your request will be registered in the exclusion list of DLVMR and electronic evidence of such request will be delivered to you.
AMENDMENTS TO THE PRIVACY NOTICE
